Welcome to MasterForge. These Terms of Service ("Terms") govern your use of the MasterForge website, applications, and audio mastering services ("Services") provided by Sunrise Software Oy ("we", "us", "our", "Company").

            By using our Services, you agree to these Terms. If you do not agree, please do not use our Services.
        

1. About Our Services

MasterForge provides browser-based audio mastering tools that process audio files locally on your device. Our Services include:

Genre-specific audio mastering tools (Metal Master, etc.)
Free audio analysis tools
Audio processing presets and algorithms

1.1 Client-Side Processing

Our mastering and analysis tools process audio files entirely within your web browser. Your audio files are not uploaded to our servers during standard mastering operations. This means:

Your audio remains on your device
We do not store, access, or analyze your audio content
Processing speed depends on your device capabilities

2. User Accounts and Registration

Some features may require account registration. When creating an account, you agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Accept responsibility for all activities under your account

3. Acceptable Use

You agree to use our Services only for lawful purposes. You must not:

Process audio content you do not own or have rights to
Use the Services for any illegal activity
Attempt to reverse-engineer, decompile, or extract our algorithms
Interfere with or disrupt the Services
Use automated systems to access the Services without permission
Resell or redistribute the Services without authorization

4. Intellectual Property

4.1 Your Content

You retain all ownership rights to audio files you process using our Services. We do not claim any ownership over your content. Since processing occurs locally on your device, we never have access to your audio files.

4.2 Our Content

The Services, including all software, algorithms, presets, designs, text, graphics, and other content, are owned by Sunrise Software Oy and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

5. Subscriptions and Payments

5.1 Free and Paid Services

We offer both free and paid subscription tiers. Paid subscriptions provide access to additional features, presets, and capabilities.

5.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. Payment is processed through our payment provider (Stripe). By subscribing, you authorize us to charge your payment method.

5.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial billing periods.

5.4 Price Changes

We reserve the right to modify pricing. You will be notified of any price changes at least 30 days before they take effect.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Services are provided "as is" and "as available". We may:

Modify or discontinue features with reasonable notice
Perform maintenance that may temporarily affect availability
Suspend access for violations of these Terms

7. Disclaimer of Warranties

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including:

Warranties of merchantability and fitness for a particular purpose
Warranties that the Services will meet your requirements
Warranties that results will be accurate or reliable

Audio mastering is subjective. Results may vary based on source material and personal preferences.

8. Limitation of Liability

To the maximum extent permitted by law, Sunrise Software Oy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Sunrise Software Oy from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Services. Continued use after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of Finland. Any disputes shall be resolved in the courts of Finland, unless mandatory consumer protection laws of your country of residence provide otherwise.
